Terms and Conditions for TickMessage

Effective Date: 01 January 2026

These Terms govern your use of TickMessage ("the Service") operated by Pacifica Labs Pty Ltd ("we", "us", "our"). By using the Service, you agree to these Terms.

1. Eligibility and Account

  • You must be at least 18 years old (or the age of majority in your jurisdiction).
  • You are responsible for maintaining the confidentiality of your account.

2. Use of the Service

You agree to use the Service only for lawful purposes and to comply with all applicable laws, including messaging and privacy regulations.

3. User Content

You retain ownership of content you upload or send. You grant us a limited license to host, process, and transmit your content solely to provide the Service.

4. Connected Services

If you connect Google or Microsoft accounts, you authorize us to access data as permitted by your authorization. You can revoke access at any time.

5. Acceptable Use

You agree not to:

  • Send spam or unsolicited messages.
  • Upload malicious code or attempt to compromise the Service.
  • Infringe third-party rights or violate privacy laws.

6. WhatsApp Integration (Important)

If you connect or use WhatsApp features:

  • WhatsApp is a third-party service owned by Meta. We are not affiliated with, endorsed by, or sponsored by WhatsApp or Meta.
  • We do not provide the official WhatsApp Business API. WhatsApp access may rely on WhatsApp Web or other non-official interfaces and may be subject to WhatsApp's terms, restrictions, or enforcement. You use WhatsApp features at your own risk.
  • Your use of WhatsApp with the Service may violate WhatsApp's terms or policies. WhatsApp may suspend, restrict, or terminate access to your WhatsApp account, phone number, or device at any time, with or without notice.
  • We do not guarantee message delivery, timing, or continued availability of WhatsApp features. WhatsApp may throttle, block, or change functionality without notice.
  • You are solely responsible for obtaining and documenting all required recipient consents and for complying with all laws, regulations, and WhatsApp policies, including anti-spam and privacy requirements.
  • You are solely responsible for any claims, penalties, or losses arising from your WhatsApp usage, including account bans, message blocking, number loss, or reputation damage.

7. Third-Party Services

The Service integrates with third parties (Google, Microsoft, WhatsApp). Their terms and policies apply to their services.

8. Fees

The Service is currently provided without charge.

9. Termination

We may suspend or terminate your account for violations of these Terms or to protect the Service.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind. WhatsApp features are used at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the Service.

13. Changes

We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the changes.

14. Governing Law

These Terms are governed by the laws of NSW, Australia, without regard to conflict of law principles.
